1. Acceptance of Terms

By accessing or using the Operaitor treatment plan presentation service (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Description of Service

Operaitor provides AI-assisted tools that help dental practices create patient-facing treatment plan presentations. The Service generates informational materials based on data you provide.

3. User Responsibilities

• You are solely responsible for reviewing and verifying all AI-generated content before sharing it with a patient.
• You must ensure that any patient information you upload or enter is handled in accordance with applicable privacy laws, including HIPAA.
• You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service.
• You are responsible for maintaining the confidentiality of your account credentials.

4. Protected Health Information & HIPAA

If you are a Covered Entity or act on behalf of one under HIPAA, your use of the Service is also governed by the Business Associate Agreement between you and Operaitor. You must accept the BAA before transmitting any Protected Health Information (PHI) through the Service.

5. AI-Generated Content Disclaimer

Treatment plan presentations generated by the Service are for informational purposes only and do not constitute medical advice, diagnosis, or treatment recommendations. All AI-generated content must be reviewed by a licensed dental professional before being shared with patients. Operaitor does not guarantee the accuracy, completeness, or clinical appropriateness of any generated content.

6. Intellectual Property

You retain ownership of the patient data and clinical information you provide. Operaitor retains ownership of the Service, its software, and underlying technology. Generated presentations are licensed to you for use with your patients.

7. Limitation of Liability

To the fullest extent permitted by law, Operaitor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Operaitor’s total aggregate liability shall not exceed the fees paid by you in the twelve (12) months preceding the event giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Operaitor, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable law.

9. Termination

Operaitor may suspend or terminate your access to the Service at any time, with or without cause. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) shall survive.

10. Modifications

Operaitor reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms with a new “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.
